Parties

Kensington Tutors Ltd (also referred to as “Kensington Tutors”, “KT”, “we” or “us”) and the individual named as the Client on the Booking Form (also referred to as “you” or “your”).

These Terms and Conditions, together with the relevant Booking Form, form the agreement between Kensington Tutors and the Client for the Services described in that Booking Form.

Definitions

“Booking Form” the document setting out the Services, Fee, payment arrangements, deliverables and any specific terms agreed for the Client’s engagement.

“Client” the individual named on the Booking Form who accepts these Terms and Conditions.

“Student” the child, young person or other individual for whom the Services are being provided.

“Consultant” a specialist or other consultant engaged or introduced by Kensington Tutors to provide part of the Services.

“Fee” the amount payable by the Client for the Services, as set out in the Booking Form.

“Services” the consulting, educational, admissions, school-search, UCAS or related services described in the Booking Form.

1. Our Services

We will provide the Services described in the Booking Form with reasonable care and skill.

The Booking Form is specific to the Client’s requirements and will set out the agreed scope of work. If you request additional work outside that scope and we agree to provide it, we will agree the additional Fee with you before carrying out the additional work.

2. Services and Completion

The Services, deliverables and intended completion point will be set out in the Booking Form.

Where a report, written advice or other deliverable is included, completion will normally occur when that deliverable has been provided and, where included in the Services, discussed with you in a consultation or follow-up call.

Completion does not depend on a later educational or admissions outcome unless the Booking Form expressly states that the Services are to continue until a specified stage or outcome. Even where Services continue until a specified stage, this does not constitute a guarantee that a school, university or other institution will make an offer or accept the Student.

3. Client Obligations

You agree to provide promptly any information and documents reasonably required for us to provide the Services.

You are responsible for ensuring that information you provide is accurate, complete and not materially misleading. We are not responsible for consequences arising from information that is inaccurate, incomplete or materially misleading.

You agree to respond reasonably promptly to requests for information, decisions or approvals where these are necessary for the Services.

4. Fees and Payment

The Fee and payment arrangements will be set out in the Booking Form.

Unless the Booking Form states otherwise, hourly consultations are payable in advance. For project work, our usual arrangement is 50% payable at the start of the project and 50% when the agreed work is completed. We may agree different arrangements in the Booking Form.

Any change to the Fee or payment arrangements must be agreed in writing.

If an amount remains unpaid after its due date, we may request immediate payment and, where appropriate, suspend further Services until payment is received.

Where applicable, payment must be made in sterling and the Client is responsible for any bank or transfer charges imposed by the Client’s bank or payment provider.

5. Kensington Tutors’ Obligations

We will provide the Services with reasonable care and skill.

Where a specialist Consultant is required, we will use reasonable care in selecting an appropriately suitable Consultant.

If a Consultant becomes unavailable, we will use reasonable endeavours to arrange a suitable replacement or alternative arrangements so that the agreed Services can continue. We cannot guarantee that a replacement will be identical to the original Consultant or available immediately.

Kensington Tutors remains responsible for managing the agreed Services even where a Consultant provides part of those Services.

6. Educational and Admissions Outcomes

We provide advice, support and assistance but cannot guarantee any particular educational, examination or admissions outcome.

In particular, we cannot guarantee admission to a particular school, university or course, an Oxbridge offer, a medical-school offer, an examination result, a particular grade, or any other decision made by an educational institution, examination board or other third party.

Any information or recommendations concerning likely suitability, competitiveness or admissions requirements are provided as professional guidance based on the information available to us and should not be treated as a guarantee of an outcome.

7. Cancellation, Postponement and Changes

If you need to cancel or postpone Services, please notify us as soon as possible.

Where you cancel after Services have begun, or where cancellation causes us to incur costs or work that cannot reasonably be avoided, we may charge or retain an amount that reasonably reflects the Services already provided and any direct loss or costs resulting from the cancellation, subject to your statutory rights.

We will take reasonable steps to minimise any loss resulting from cancellation, including seeking to reschedule work where reasonably possible.

Changes to the agreed Services should be agreed in writing. Changes which require additional work may result in an additional Fee, which will be agreed before the additional work is undertaken.

Nothing in this clause limits any statutory cancellation or consumer rights that apply to you.

8. Consumer Cancellation Rights

Where you are a consumer and the law gives you a statutory right to cancel a distance or off-premises service contract, we will provide the information required about that right and how it may be exercised.

If you expressly request that we begin providing the Services before the end of the applicable cancellation period, we may begin the Services before that period has expired.

If you cancel after the Services have begun following your express request, you may be required to pay a proportionate amount for the Services supplied up to the time you communicate your cancellation, where permitted by law.

Where the Services are fully performed during the cancellation period following your express request and you have acknowledged that you may lose the statutory right to cancel once the Services are fully performed, that right may cease where permitted by law.

Nothing in these Terms and Conditions affects any statutory right or remedy that cannot lawfully be excluded or restricted.
